1.I understand the nature of Camel City CrossFit activities and believe I am qualified to participate in such Activity.
I further acknowledge that I am aware the activity will be conducted in facilities open to the public during the Activity.
I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the Activity.
2. I FULLY UNDERSTAND that: (a) Camel City CrossFit Activities involve risks and dangers of SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS AND DEATH (“Risks”);
(b) these Risks and dangers may be caused by my own actions,
or inaction’s, the actions or inaction’s of others participating in the Activity, the condition in which the Activity takes place, or THE NEGLIGENCE OF THE “RELEASEES” NAMED BELOW;
(c) there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL
RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES incurred as a result of my Participation in the Activity.
3. I HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS Camel City CrossFit, their respective administrators, directors, agents,
officers, volunteers, and employees, other participants, any sponsors, advertisers, and if applicable, owners and lessors of premises on which the Activity takes place (each considered one of the
“Releases” herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the “Releases” or otherwise, including
negligent rescue operations and further agree that if, despite this release, I, or anyone on my behalf makes a claim against any of the Releases named above, I WILL INDEMNIFY, SAVE AND HOLD
HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS LIABILITY, DAMAGE OR COSTS ANY MAY INCUR AS THE RESULT OF ANY SUCH CLAIM.
4. CONSENT AND RELEASE FOR USE OF LIKENESS
Effective as of the date subscribed to above, approval for past use and permission for present and future use is being granted to Camel City Performance, LLC, doing business as
Camel City CrossFit,to use a photo, video, or other image of the undersigned Member. Permission is being given by the undersigned as more fully explained in this Consent and Release.
The undersigned is an adult, over the age of eighteen (18) and is fully authorized to sign this Consent and Release.
For a valuable consideration, receipt of which is hereby acknowledged, the undersigned hereby grants to Camel City CrossFit, its agents, employees, and licensees all ownership rights and the
absolute and irrevocable right and permission to copyright, use and publish photographed likeness of Member that may be obtained pursuant to this Consent and Release.
The likeness may be copyrighted, used and/or published individually or in conjunction with other photography or video work and in any medium (such as Facebook) for any lawful purpose,
including without limitation, for marketing materials such as trade materials, illustrations, social media advertisements or any other form of promotion.
The undersigned represents and warrants that (i) no other party has been granted an exclusive license with respect to the likeness of Member, and (ii) no other party’s authorization or consent is
required with respect to the permission granted to the Released Party under this Consent and Release.
The undersigned waives any right the undersigned may have to inspect or approve the Member’s use of the likeness or the advertising copy or printed matter that may be used by
Camel City CrossFit in any promotional items, as described herein.
I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND IT’S TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT ANY
INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE
THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THAT THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.
